Rulemaking - Informal Comment Period for Chapter 173-408 WAC, Landfill Methane Emissions


Thank you for your interest in this rulemaking, which will create a new Chapter in the Washington Administrative Code: Chapter 173-408 WAC - Landfill Methane Emissions.  


The purpose of this new chapter is to implement Reducing Methane Emissions from Landfills (Engrossed Second Substitute House Bill 1663, Chapter 179, Laws of 2022, codified as Chapter 70A.540 RCW).   


Ecology is planning to address the following topics in this rulemaking: 
  • Reporting requirements  
  • Monitoring requirements  
  • Technology installation and performance requirements  
  • Penalties for violation of law and implemented rules  
  • Other possible requirements

After the informal comment period ends, we will:  
  • Consider all comments as we develop the proposed rule

  • Propose the rule with a formal public comment period that includes a public hearing
